Justification
Safeguarding Prosecutorial Independence and Strengthening the Rule of Law: The current prosecutorial framework is vulnerable to perceived executive influence due to institutional overlap with the Attorney General’s Chambers and limited administrative autonomy. Establishing a National Prosecution Authority (NPA) will provide a clear constitutional and institutional separation, ensuring that prosecutorial decisions are made independently, transparently, and strictly in accordance with the law. This is essential for strengthening the rule of law, enhancing accountability, and restoring public confidence in the justice system.
Addressing Systemic Inefficiencies and Enhancing Performance: The existing system is characterized by fragmented operations, weak coordination, absence of centralized case management, and inconsistent application of prosecutorial standards. The NPA will introduce integrated systems, harmonized procedures, and professional staffing structures that will significantly improve case management, reduce delays and backlogs, and enhance overall efficiency and effectiveness in the prosecution of cases.
Building Institutional Capacity to Respond to Complex and Emerging Crimes: Malawi’s current prosecutorial system is not adequately equipped to address increasingly complex crimes such as corruption, financial crimes, cybercrime, and gender-based violence. The establishment of the NPA, with specialized units and a professionalized cadre of prosecutors, will strengthen the country’s capacity to investigate and prosecute such offences effectively, ensuring a more responsive and modern justice system aligned with national and international standards.
Enhancing Transparency and Accountability in Prosecutorial Decision-Making: The current system lacks robust mechanisms for tracking, reporting, and reviewing prosecutorial decisions, which can lead to inconsistencies and perceptions of bias. The establishment of the NPA, supported by clear oversight structures and reporting frameworks, will promote transparency in decision-making and strengthen accountability through performance monitoring, documentation, and parliamentary oversight.
Strengthening Public Confidence in the Justice System: Public trust in the justice system is often undermined by delays, perceived political interference, and inconsistent prosecutorial outcomes. By creating a professional, independent, and transparent prosecution authority, the reform will enhance public confidence in the fairness and integrity of the justice system, which is critical for social stability, compliance with the law, and democratic governance.
Aligning Malawi with Regional and International Best Practices: Many jurisdictions in the region, such as Kenya and South Africa, have established independent prosecution authorities with clear governance frameworks and operational autonomy. Establishing the NPA will align Malawi’s prosecutorial system with these best practices, enhancing its credibility, facilitating international cooperation, and strengthening its position in addressing transnational and complex crimes.
