Justification
Enhancing Access to Justice: The current concentration of prosecutorial services in Lilongwe, Mzuzu and Blantyre limits access for populations in remote districts. Decentralisation will ensure equitable access to prosecution services and uphold constitutional guarantees of fair trial and justice.
Improving Efficiency and Reducing Case Backlogs: Centralized operations contribute to delays in case handling and prolonged remand periods. Establishing district-level prosecution offices will enhance case flow management, reduce backlog and improve timeliness in the administration of justice.
Reducing Operational Costs: Frequent travel by prosecutors to districts results in high expenditure on transport and allowances. Decentralisation will significantly reduce these recurring costs and improve overall efficiency in resource utilization.
Strengthening Coordination within the Justice System: Limited prosecutorial presence at district level weakens coordination with police, courts, and prisons. Deploying prosecutors closer to service points will enhance collaboration, improve case preparation, and reduce procedural inefficiencies.
Promoting Professionalism and Quality of Prosecution: The absence of prosecutors in districts often leads to reliance on non-legally trained personnel. Expanding prosecutorial services will ensure that qualified prosecutors handle cases, thereby improving legal quality, consistency, and adherence to standards.
